Open only to legal residents of the United States, 18 years of age or older. Employees, officers and directors of Sponsor, its parent company, subsidiaries, affiliates; any agencies/entities involved in the development, production or administration of the Sweepstakes; or Alterra Mountain Company, are not eligible to enter or win the prize. Sweepstakes is offered only at this Resort. Void elsewhere and where prohibited by law.

 

By entering this Sweepstakes, you agree to abide by and be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all respects and not subject to appeal.

 

 

 

1. SWEEPSTAKES PERIOD: 

 

Sweepstakes is available only during the times posted at the Sweepstakes area. Sponsor’s computer is the official clock for all purposes of the Sweepstakes.

 

Sponsor will conduct sweepstakes promotions at other times and/or at other Resorts with the same prize of a Smartwool baselayer kit (see Rule 5 below) in Winter 2025/Spring 2026. Each sweepstakes promotion is separate and apart from all other sweepstakes promotions (including this Sweepstakes), with its own prize being made available at different odds of winning. Your entry as per Rule 2 below is valid only for this Sweepstakes. You may enter (and possibly win the prize) in this Sweepstakes and one or more other sweepstakes promotions offered at other times/Resorts, as you wish.  Each sweepstakes promotion is subject to its own official rules which will be posted at the corresponding sweepstakes promotion area. 

  

2. HOW TO ENTER:

 

1.  Entry Method No. 1:

 

Access the Sweepstakes website at https://www.smartwool.com/en-us/sweepstakes.html.  Once on the Sweepstakes website, provide your e-mail address and check the box indicating your agreement to receive promotional marketing e-mails from Smartwool.  Before doing so, it is strongly recommended that you carefully review Sponsor’s Privacy Policy available at https://www.smartwool.com/en-us/privacy-policy.html, regarding how Smartwool collects and uses your personal information.  You may opt out of receiving promotional marketing e-mails at a later time without affecting your ability to enter the Sweepstakes.

 

If you already opted-in to receive promotional marketing e-mails from Smartwool, simply check the designated box to enter via this method.

Receipt of entry may be acknowledged but any such acknowledgment is not binding upon Sponsor.

If you participate in the Sweepstakes via compatible mobile device, you will be solely responsible for any Internet access charges and other fees incurred in conjunction therewith, as per your wireless carrier’s rate plan. 

 

2. Entry Method No. 2: 

 

Print your name, complete address (including zip code), e-mail address (if any), and “SMARTWOOL BASELAYER KIT GIVEAWAY” on a 3” x 5” card and deposit in the designated box on-site by the posted end of the Sweepstakes Period. (Do NOT give the 3” x5” card to Sponsor’s Brand Ambassadors/representatives or any other person). Paper entry is void if mechanically reproduced/copied. Paper entry becomes the sole property of Sponsor. Receipt of paper entry will not be acknowledged and paper entry will not be returned.

 

If entering via 3” x 5” card, your personal information will only be used for purposes of Sweepstakes administration, including winner notification (if applicable) in accordance with Sponsor’s Privacy Policy at  https://www.smartwool.com/en-us/privacy-policy.html. By entering, you agree to the terms of Sponsor’s Privacy Policy.  

 

3. ADDITIONAL ENTRY RESTRICTIONS:  

1. Limit of one (1) entry per person. If you enter more than once, you will be disqualified from the Sweepstakes altogether and all your entries will be void.
2. Use of automated, programmed or like means of entry (including third party sweepstakes entry services) is prohibited. 
3.  Proof of submission of entry information (including 3” x 5” card) does not constitute proof of receipt of same or proof of entry.

 

4. WINNER SELECTION & NOTIFICATION:

 

1. One (1) entrant will be selected as the potential prize winner in a random drawing from among all eligible entries received.  Sponsor will conduct the random drawing on or about two (2) business days after the end of the Sweepstakes Period.
2. Potential prize winner will be notified via e-mail for entry via Entry Method 1 and only if provided for entry via Entry Method 2. (If not provided, if potential prize winner entered via Entry Method 2, they will be notified by postal mail.)  Potential prize winner may be required to sign a Declaration of Eligibility, Liability Release and a Publicity Release (where legal), which if required, must be returned within five (5) days of date of notification. If potential prize winner cannot be notified by Sponsor despite reasonable efforts to do so; if they fail to timely return the signed Declaration/Release (if applicable); or if Sponsor determines that they are ineligible or otherwise not in compliance with these Official Rules, the prize will be forfeited without compensation of any kind. In the event of prize forfeiture, Sponsor may award the prize to an alternate winner selected in a random drawing from among all remaining eligible entries received.

 

5. PRIZE/APPROXIMATE RETAIL VALUE (“ARV”) AND ODDS OF WINNING:

 

Prize (1) – a Smartwool baselayer kit consisting of baselayer top and bottom. Approximate Retail Value: $230.

 

Top and/or bottom may be subject to availability as to size, color, fit and material.

 

Odds of winning the prize depend on the total number of eligible entries received.

 

6. PRIZE RESTRICTIONS:

 

1. Prize must be accepted by winner as awarded. Prize must be accepted in its entirety or not at all.

 

2. Prize is not transferable except with Sponsor’s permission, which may be granted or withheld in Sponsor’s sole discretion and without liability of any kind. 

 

3. Prize will only be delivered to a street address in the United States.

 

4. Sponsor reserves the right to award the prize elements to winner in separate shipments.

 

5. No prize substitution permitted except by Sponsor due to unavailability of prize/prize element for any reason and only then for prize/prize element of equal or greater value. 

 

6. Prize is NOT redeemable or exchangeable by winner for cash.

 

7. Taxes on prize and unspecified expenses related to acceptance/use of prize are winner’s sole responsibility.

 

8. By accepting prize, where legal, winner agrees to the use of their name, photograph, likeness, voice, nickname and other indicia of their identity/persona for advertising/trade/publicity purposes by Sponsor without further compensation or notice.

7. ADDITIONAL CONDITIONS OF PARTICIPATION:

 

1. By participating, entrant releases and agrees to hold harmless Sponsor, Alterra Mountain Company, their respective parent companies, subsidiaries, affiliates, or of any agencies/entities involved in the development, production or administration of the Sweepstakes; and the directors, officers, employees and agents of any of the above organizations from any and all liability arising from the Sweepstakes or the receipt, acceptance, use or misuse of prize.
2. Sponsor is not responsible for late, lost, illegible/garbled, stolen, inaccessible, corrupted, incomplete, delayed, damaged or misdirected 3” x 5” cards or entries; all of which are void. Sponsor is also not responsible for programming, electronic, technological, telephonic, network or other malfunction, error or failure which in any way affects or interferes with the operation of the Sweepstakes; or for entries not timely received or not received in a usable format for any reason.
3. If Sweepstakes cannot be conducted as originally planned due to any cause beyond Sponsor’s control (e.g., computer virus, act of fraud, natural disaster), Sponsor may cancel/suspend/modify Sweepstakes and determine the winner in a manner determined by Sponsor in its sole discretion to be fair, appropriate and consistent with these Official Rules.

 

4. Tampering with Sweepstakes or violation of these Official Rules will result in disqualification from the Sweepstakes; but, disqualification shall not represent the sole remedy available to Sponsor.

 

5. Sponsor’s failure to enforce any provision of these Official Rules in a given instance is NOT a waiver of such provision.

 

6.  Any dispute or claim regarding the Sweepstakes will be resolved pursuant to the internal, substantive law of the State of Delaware. Any such dispute/claim must be brought individually (NOT as part of a class action) in the federal or state courts in the State of Delaware with recovery being limited to one’s actual costs in participating in the Sweepstakes (if any) with all damages or other forms of recovery being expressly waived.

 

7. If any provision of these Official Rules is determined by a court of competent jurisdiction to be invalid, illegal or unenforceable, it shall be replaced by a substitute provision that most closely approximates the original intent of Sponsor and is valid, legal and enforceable. The invalidity/illegality/unenforceability of a given provision shall not affect the remainder of these Official Rules.

Winner’s list will be available approximately three (3) weeks after the end of the Sweepstakes Period; winner’s list request must be received no later than ten (10) days after the end of the Sweepstakes Period (if this deadline falls on a Saturday/Sunday or U.S. Federal Government Holiday, then the next business day).
